A Short Brief of NIA

It was felt that there was a need for setting up an Agency at the Central level for investigation of offences related to terrorism and certain other Acts, which have national ramifications. Several experts and Committees, including the Administrative Reforms Commission in its Report, had made recommendations for establishing such an Agency.

The Government after due consideration and examination of the issues involved and Accordingly the NIA Act was enacted on 31-12-08 and the National Investigation Agency (NIA) was born. At present NIA is functioning as the Central Counter-Terrorism Law Enforcement Agency in India. The Governing body is Ministry of Home Affairs Government of India and its Headquarter at – CGO Complex, Lodhi Road, New Delhi-110003.

NIA has registered and investigated more than 180 cases till date and out of  35 cases have ended in conviction. NIA has an enviable conviction percentage of more than 94.00%.

NIA is exempted under Section 24 read with the Second Schedule of the Right to Information from the application of the Act, except in so far as the allegation of corruption or human right is concerned.

Founder Director

The founding Director-General of NIA was Radha Vinod Raju, His first appointment as Superintendent of police in Poonch District, Jammu and Kashmir. Then he joined SP in Central Bureau of Investigation (CBI), Ernakulam. After that he served as DIG in Jammu and Kashmir. On 19 January 2009, he was appointed as the first chief of India's National Investigation Agency and he served till 31 January 2010. Presently  In the year 2017, Y.C.Modi was named as Chief of NIA.

NIA SPECIAL COURTS

Various Special Courts have been notified by the Govt. of India for the trial of the cases arising out of offences committed in various states of the Union. The 30 special Court / Judge Notified under the NIA Act in Various State. Whereas 7 in Union Territories.

Recent SUCCESS of NIA

1. Now NIA has been active in the war against terror in Jammu and Kashmir. On January 18, 2018, NIA filed a charge sheet (including  300 witnesses 950 Incriminating Documents and 600 Electronics Devices) against 12 people including Lashkar-e-Taiba terror group chief Hafiz Saeed and Hizbul Mujahideen chief Syed Salahuddin. NIA has also stated that the war against terror in   Kashmir is not about terror funding alone, it's about a conspiracy to wage war against India. During the investigation the NIA has arrested people allegedly involved in stone-pelting incidents for the first time including Kashmiri photojournalist Kamran Yusuf (Kamran Yousuf)
2. NIA files charge sheet in the case of Recovery and Explosion of IEDs in Bodhgaya Temple Complex, Bihar Today, i.e. on 27.09.2018, NIA filed a charge- sheet in Special NIA Court, Patna in case No.RC04/2018/NIA-DLI (Recovery and explosion of IEDs in Bodhgaya Temple Complex, Bihar) against 03 accused persons for their involvement in terrorist act of planting three IEDs in and around Bodhgaya temple complex on 19th Jan 2018. The case has arisen out of crime no 34/2018, dated 20.01.2018 of PS Bodhgaya, Gaya, Bihar. On 19.01.2018, on receiving information that some suspicious objects are lying near the Kalchakra Maidan, Bodhgaya under a generator set, the police secured the site and during the search of the whole premises two more live IEDs were recovered.
3. The charge sheet has been filed under sections 120 B, 121A, 122, 123 of the IPC, Sec 16, 18 & 20 of UA (P) Act, and Sec. 4 & 5 of the Explosive Substances Act. Charge-sheeted accused are: (i). Paigambar Sheikh @ Abdul Aziz son of Late Hazrat Ali, resident of Kankuria, PS Samshergunj, Dist Murshidabad, (ii). Ahmad Ali @ Kalu son of Late Hussain Ali, resident of Ratanpur, PS Samshergunj, Dist Murshidabad, and (iii). Nur Alam Momin son of Mansur Momin, resident of Kamat, Mominoara, Dhulian, PS Samshergunj, Dist-Murshidabad, West Bengal.
4. An investigation has also revealed the involvement of accused i) Jahidul Islam@Kausar of Jamalpur, Bangladesh, ii) Mustafizur Rahman @ Shaheen of Birbhum, West Bengal, iii) Adil Sheikh, Dilwar Hossain, iv) Abdul Karim of  Murshidabad, West Bengal and v) Arif Hussain @ Anas of Barpeta, Assam. Four of these accused persons were arrested in Aug 2018 while accused Arif Hussain is still absconding.
5. The investigation brought out that accused Jahildul Islam @ Kausar is a senior member of Jamaat-ulMujahideen (JMB), Bangladesh. Mustafizur Rahman @ Shaheen is his close confidant. Accused Paigambar Sheikh, Ahmad Ali, Nur Alam, Adil Sheikh, Dilwar Hossain, Abdul Karim and Arif Hussain are all members of JMB. Accused Jahidul Islam @ Kausar and Mustafizur Rahman @ Shaheen entered into a conspiracy with their other associates to carry out terror incidents in India by way of planting IEDs and carrying out explosions at symbols of Buddhist faith in order to show solidarity with the Rohingya Muslims fighting with Myanmar Government and to cause loss to public life and property, to wage war against Government of India and to overawe the Government of India.
6. In furtherance of the conspiracy, the accused persons contacted and assembled together at various places, took hideouts at Jahanabad and Masaurhi in Bihar, carried out reconnaissance of the targets at Bodhgaya and procured explosives and other materials for the manufacture of the IED. Accused Jahidul Islam with the help of other co-accused made 3 IEDs and 2 hand grenades. The IEDs were planted by Adil Sheikh, Dilwar Hossain and Arif Hussain in the premises of Bodhgaya on 19th Jan, 2018 in order to cause loss to public life and property during the auspicious presence of his holiness the Dalai Lama and also during the visit of his Excellency the Governor of Bihar at Bodhgaya, thus committing a terrorist act.
